By accessing or using Actium Chat ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Actium Chat is a multi-model AI orchestration platform that enables users to interact with various AI models, store conversation history, and utilize features such as cross-model review, code execution, and file analysis.

3. User Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account.

4. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or abusive content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Attempt to circumvent security measures or rate limits
  • Reverse engineer or extract source code from the Service
  • Use the Service for competing product development

5. Intellectual Property

You retain ownership of content you create using the Service. We retain ownership of the Service, including all software, designs, and documentation. AI model outputs may be subject to the terms of the underlying model providers.

6. Payment and Billing

Paid features are billed according to our published pricing. Payments are processed through Stripe. You authorize us to charge your payment method for all fees incurred. Refunds are provided at our discretion.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. Scheduled maintenance will be announced in advance when possible.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.

9. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Service, your content, or your violation of these terms.

10. Termination

We may terminate or suspend your account for violations of these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These terms are governed by the laws of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
